Prop 65 settlement finalized for belts, footwear & handbags

A California Proposition 65 settlement involving purses, handbags, clutches, totes, wallets, belts, and footwear has recently been reached for lead content. The settlement is the first to establish lead limits for all footwear and belts. The lead limits required by the settlement have different implementation dates for manufacturing, selling, material type, and product type as summarized below.

Companies that are both the manufacturer/supplier or importer and seller of products must meet the above manufacturing/supplying/importing limits and dates, but they may continue to sell products imported before these dates, up until the selling dates.

Exemptions
• Cubic zirconia, crystal, glass, and rhinestones
• All Non-Suspect Materials, except for leather, as defined by the Consumer Products Safety Commission in 16 CFR § 1500.91 (d) and (e):
• Certain precious gemstones, semiprecious gemstones, CMYK printing inks, pearls, wood, paper, textiles, surgical steel and precious metals.

Existing Inventory
• Purses, handbags, clutches, totes, wallets, belts, and footwear imported, or manufactured before December, 1 2010 that do not meet the lead limit requirements may be sold after December 1, 2011 providing they include the warning statement specified in the settlement.
