EC publishes communication on preparing for Brexit

The European Commission (EC) recently adopted a communication outlining the ongoing work on the preparation for all outcomes of the United Kingdom's exit from the European Union (EU). The communication, which followed a request by the European Council in June to intensify preparedness at all levels, called on member states and private parties to step up preparations.

The United Kingdom will leave the EU on March 30 next year and this will have repercussions for citizens, businesses and administrations on both sides, including new controls at the EU's outer border with the United Kingdom, the validity of UK-issued licences, certificates and authorisations and different rules for data transfers, according to an EU press release.

While the EU is working day and night for a deal ensuring an orderly withdrawal, the United Kingdom’s withdrawal will undoubtedly cause disruption, for example in business supply chains, the press release said, whether or not there is a withdrawal agreement.

As there is still no certainty that there will be a ratified withdrawal agreement in place on that date, or what it will entail, preparations have been ongoing to try to ensure that the EU institutions, member states and private parties are prepared for the withdrawal.

If the withdrawal agreement is ratified before March 30, EU law will cease to apply to and in the United Kingdom on January 1, 2021, i.e. after a transition period of 21 months. If the agreement is not ratified before March 30, there will be no transition period and EU law will cease to apply to and in the United Kingdom. This is referred to as the ‘no deal’ or ‘cliff-edge’ scenario.

Preparing for the withdrawal is the responsibility of not only EU institutions, but also economic operators and other private parties, the EU press release added. (DS)
