Govt presents MP allowing suspension of IPR

The administration of President Luiz Inacio Lula da Silva published an executive order (MP) allowing for suspension of intellectual property rights, including rights over patents and copyrights.

The MP can be enforced immediately but must later be approved by Congress.

The MP paves the way for the government to suspend royalty payments and take other measures against holders of patents and copyrights. The government has hinted that it may wish to use such methods as sanctions against the U.S. in a case involving alleged U.S. cotton subsidies.

Earlier this week, the government said it would apply tariff hikes to certain U.S. products as part of a system of sanctions in the cotton case.

Established in 1976, the Brazil-U.S. Business Council was created to foster understanding and advance business priorities between the U.S. and Brazil. The U.S. Section of the Council represents the majority of the largest U.S. corporations invested in Brazil and works collaboratively with the U.S. Chamber of Commerce.
