Antik Denim's counterfeit seizures at MAGIC trade show

Denim company Blue Holdings Inc is a designer, maker and distributor of high-end fashion jeans and denim apparel through its wholly owned subsidiary Antik Denim, LLC, won a temporary restraining order and seizure of hundreds of counterfeit jeans, catalogues and promotional materials on display at MAGIC marketplace, a leading fashion industry trade show.

The company in question is charged with infringing on Antik Denim's highly identifiable pocket design as featured on their high-end jeans, with the court having found that the pockets "are substantially and confusingly similar to Antik's Stylized Design." The seizures took place on August 31, 2005.

The unique design is copyrighted, and is the subject of pending trademark and design patent registration claims. "They will vigorously enforce their proprietary rights, including trademarks and copyrights, which are the cornerstone of reputation among the country's premier retailers with whom do business," said Antik General Counsel, Deborah Greaves. "It was imperative to stop them from flooding the market with an inferior product."

Blue Holdings Inc, through its subsidiary Antik Denim, LLC, has already sued various other companies for making or distributing knockoffs of its designs, but this is the first time a court-ordered seizure has taken place. "They undertook this legal endeavor to send the message to stores and distributors that won't tolerate anyone stealing the work of talented designers," said Paul Guez, Chairman, Chief Executive Officer and President of Antik's parent company, Blue Holding Inc. Guez continued, "If stores want to sell designs, they should come to us."

California based Blue Holdings Inc, directly and through its wholly owned subsidiary Antik Denim, LLC, designs, develops, manufactures, markets, distributes and sells high-end fashion jeans, apparel, and accessories with a western flair under the "Antik Denim" and "Yanuk" brands, both in the United States and internationally. Blue Holdings currently sells men's and women's styles and is in the process of launching a children's line.
