ASICS America Corp files lawsuit against Payless Shoesource Inc

Footwear Manufacturer ASICS America Corporation and ASICS Corporation Japan (Kobe, Japan) announced today that they have filed a lawsuit in Federal District Court in the US District Court, Central District of California against Payless Shoesource, Inc. (Topeka, Kansas) for trademark infringement, unfair competition, trademark dilution and false advertising.
ASICS is seeking a preliminary and permanent injunction against Payless to prevent any future sales and distribution of their shoes, in particular their CHAMPION brand shoes, which bear a stripe design similar to ASICS famous Stripe Design trademark. In addition, ASICS is also seeking damages including profits and attorney fees from Payless.
