NLRB pushing big labor's agenda at expense of jobs

The National Retail Federation applauded a lawsuit filed by the Coalition for a Democratic Workplace and the U.S. Chamber of Commerce challenging the National Labor Relations Board's “ambush” election regulation that was issued.

NRF, representing an industry that supports one in four American jobs, is a founding member of the Coalition for a Democratic Workplace and currently leads its lobbying activities on Capitol Hill.

“The NLRB is once again pushing big labor's regulatory agenda at the expense of America's job creators,” NRF Senior Vice President for Government Relations David French said.

“This union dominated and controlled Board has repeatedly ignored calls for constraint. It has failed to uphold its responsibility for fairness and impartiality when it comes to union organizing and union elections.

“It's ironic that the rule is issued on the last day for priority shipping to arrive in time for Christmas, because the NLRB is rushing ahead with a special holiday gift for union organizers at the expense of employees and America's job creators,” French said.

“This rule shows that Board is abandoning their role as arbiter of fairness in the union organizing process and pushing one goal - to ensure that unions win more campaigns.”

Earlier, the NLRB released its final rule on union election procedures significantly stifling employers' rights during the union election process. The new rule alters long-standing labor relations standards, eliminates key employee and employer protections and drastically shortens the time-frame for a union election.

Shortly after the new rule was issued two organizations, the Coalition for a Democratic Workplace and U.S. Chamber of Commerce filed suit challenging the new NLRB rule in the U.S. District Court for the District of Columbia.

In filing the lawsuit, the Chamber, the NRF and other members of the Coalition for a Democratic Workforce are asking the court to restore balance to the NLRB by enjoining the Board from enforcing the rule.

As the world's largest retail trade association and the voice of retail worldwide, NRF represents retailers of all types and sizes, including chain restaurants and industry partners, from the United States and more than 45 countries abroad.

Retailers operate more than 3.6 million U.S. establishments that support one in four U.S. jobs – 42 million working Americans.

Contributing $2.5 trillion to annual GDP, retail is a daily barometer for the nation's economy. NRF's Retail Means Jobs campaign emphasizes the economic importance of retail and encourages policymakers to support a Jobs, Innovation and Consumer Value Agenda aimed at boosting economic growth and job creation.
