LANXESS responds to settlement agreement reached with Ohio EPA

Ohio EPA and Hamilton County Department of Environmental Services, represented by Ohio Attorney General Marc Dann's office, have reached an agreement under which Lanxess of Addyston will conduct more studies to determine what is causing the facility to emit unacceptable levels of air pollution.
By March 31, 2007, the company agreed to submit evaluations of additional control measures for lowering 1,3 butadiene and acrylonitrile. Ohio EPA will use the results to determine if future actions are necessary to control emissions from the facility.
Ohio EPA and Hamilton County Department of Environmental Services remain concerned about the long-term health impacts related to the company's emissions of 1-3 butadiene and acrylontirile.
The negotiated agreement settles the company's appeal of Ohio EPA's November 7, 2006, Findings and Orders.
In exchange for Lanxess agreeing to provide Ohio EPA with all of the information it sought in the November 2006 orders, the parties agreed not to litigate at this time before the Environmental Review Appeals Commission as to whether the company is a public nuisance.
