The April advertising flyer of retail chain Lidl featured trekking shoes bearing the Sympatex brand. Sympatex Technologies GmbH suspected that the trekking shoes in question were not original Sympatex licensed products and proceeded to take legal action.
On 23 May 2006, Sympatex Technologies GmbH won a temporary injunction at the first-instance regional court of Stuttgart, Germany, prohibiting Lidl from using the Sympatex brands in question for shoes, notably for hiking boots, and membranes in its business activities without the consent of the copyright holder.
The ruling is not yet final, as it is open to appeal before the higher regional court.
Sympatex Technologies GmbH is a German company with headquarters in Wuppertal, a city with a long tradition in ribbon-making and dyeing. Sympatex is a member of the Ploucquet Group, Heidenheim, (www.ploucquet.de). The Ploucquet Group is a leading specialist in textile finishing in Europe.
