Mafatlal serves legal notice for misuse of trademarks

Mafatlal Industries, a flagship company of Arvind Mafatlal Group, has served legal notice with clause of criminal proceedings to over 300 fabric manufacturers, distributors and dealers for misusing Mafatlal trademark/logo on the manufactured /sold fabrics which are not manufactured by Mafatlal Industries.
 
“The company has planned strict legal action in the nature of civil and criminal proceedings against them to stop misuse of using Mafatlal trademarks and logos and manufacturing/marketing of spurious goods,” Mafatlal Industries said in a press release.
 
According to the company, fabric manufacturers, distributors and dealers to whom legal notice has been served are misusing “mafatlal” trademarks in styles and fonts registered by Mafatlal Industries with suffix or prefix to Sungrace and Stanrose names over and above some other names.
 
“Mafatlal Industries Limited (MIL) is the owner of the trademark and copyrights in the intellectual properties in all the name, font and style of Mafatlal, Mafatlal Suitings, and Mafatlal Fabrics. MIL has the sole and exclusive rights to use the said intellectual properties in respect of all their business activities,” MIL said.
 
“Usage of MIL registered trademarks or similar marks upon or in relation to any goods /services with or without any prefix or suffix on any selvedges, face plates, stickers or labels will amount to infringement and or passing off under common law,” MIL added.
 
Illegal use of Mafatlal trademarks and logos is mainly taking place in Mumbai, Ichalkaranji, Ahmedabad, Bhiwandi, Bhilwara, Surat, Kerala and Erode, the company said.
